This agreement governs your use of the BusinessBankruptcies.com service and the data provided by this service. By subscribing to the service, whether a free subscription or a paid premium subscription, you agreed to abide by and be bound by these terms of service.
BusinessBankruptcies.com provides information on business bankruptcies, including bankruptcy case data, docket data, notification of new bankruptcy cases updated docket data, and cases that match certain search criteria.
While we do our best to insure that we provide the best data possible in a timely fashion, we do not warrant the accuracy, completeness, or timeliness of any of the data provided through the service. The Information is provided as is without warranty of any kind, express or implied, including, but not limited to, implied warranties of merchantability, completeness, fitness for a particular purpose, or non-infringement.
We do our best to insure that this service is available at all times. However occasionally, due to circumstances beyond our control, including technical issues with the Federal PACER system, parts or all of our service may be unavailable. Additionally, our service may occasionally be unavailable during a maintenance window, which we try to schedule during times of low usage.
A subscription can be used by a single person on any number of devices. We monitor account usage for evidence of account sharing. Any attempt to share an account among multiple users can result in account suspension.
The data we provide can be used by a single person personally or on behalf of a single entity only. Any attempt to republish or otherwise distribute data obtained through this service can result in account suspension. Any attempt to scrape or otherwise capture content from this site in bulk can result in account suspension.
Any breech of acceptable use can result in suspension of your account without a refund for the unused portion of a paid subscription.
If you sign up for our Starter, Standard, Pro, or VIP monthly subscription plans, the subscription will be automatically renewed on the monthly anniversary of your original subscription, until you cancel it. If you sign up for our Starter, Standard, Pro, or VIP annual subscription plans, the subscriptions will be automatically renewed on the yearly anniversary of your original subscription. You can cancel your subscription by going to the Billing tab of the My Account link.
Our service includes the ability to purchase docket documents. The cost of each document is presented to you before you purchase. At the time of purchase, if you have already entered credit card information (free accounts) or if you are signed up for a subscription plan (whether or not it is marked for cancellation), when you click on the View PDF link, you will be charged for the document.
On-demand docket updates are allocated at for each (Pro or VIP) plan on a monthly basis. On the monthly anniversary of the original plan subscription date, the number of available on-demand docket updates will be reset to the maximum for the monthly period. Yearly subscriptions will also adhere to monthly on-demand docket update allocations. There is no carry-over for unused on-demand docket updates between monthly / subcription periods. At the beginning of each monthly / subscription period, the docket update counter is reset to zero and you can manually update dockets as many times as your plan allowes for each month.
If you cancel your plan, your plan will no longer be automatically renewed. You will have access to the service until the last day of your current subscription period, at which time your account will revert to a free account. Note that you can still incur charges such as docket purchases will your plan is active but marked for cancellation. We do not offer refunds for the unused portion of a monthly plan from the time of cancellation to the end of the subscription period.
If you cancel an annual plan, your subscription will be active for the remainder of the yearly subscription period, and will not renew; we do not provide refunds for annual plan cancellations.
If you downgrade to a lower cost plan, the pro-rated difference between the cost of your current plan and the new plan, for the remainder of your current subscription period, will be applied to your account as a credit. This credit will be used for future subscription charges and document purchases. We do not provide refunds for credit generated as a result of a plan downgrade.
If you have exceeded the number of allowed docket updates for a lower cost plan, you can't downgrade to a lower cost plan until after the next subscription renewal.
If you have more saved cases or saved searches than are permitted for a lower cost plan, you must delete some saved cases or saved searches so that you are below the limit for the lower cost plan, before you can downgrade.
We do not provide refunds for documents once they are purchased.
Please note that we do not offer refunds for single cases once they have been purchased. To stop receiving update notifications for a sigle case purchase, go to the Saved Cases tab and delete the case from your saved cases list.

For each of our Starter, Standard, Pro, and VIP subscription plans, we offer annual billing. When you opt to be billed annually, you will receive a 2-month discount to the annualized monthly plan price; 12 months of service for 10 times the monthly subscription cost.
If you cancel your annual subscription at any time, your subscription will continue to be active for the remainder of the year subscription period, and will not renew thereafter.
The single case subscription allows a customer to follow a single case throughout the life of the case. It includes the following:
When you save a case, we will update the docket frequently and email you when new entries appear. For active cases, we typically do this every weekday. For cost efficiency, we reserve the right to reduce the fequency of docket updates for less active cases. This means that if a case you are following only shows a new docket entry once a week or so, we may only update the docket every other weekday. Similarly, if a case hasn't seen a docket update in weeks, we may only update the docket once per week.
While we do our best to include every possible new business bankruptcy in our database each week day, we rely on the PACER federal bankruptcy database for our data, and omissions in this database or other technical issues mean we may occasionally miss a business related bankruptcy filing entirely, or for an number of days after it is initially filed.
Because of this, on rare occasions, we may fail to properly notify when a monitored EIN or SSN is included in a bankruptcy filing.
By signing up for our free service or one of our subscription plans, you are agreeing to receive service related emails from us and other emails that we feel are relevant to your continued use of our service. These include but are not limited to,

We offer some documents, such as the petition, free to paying subscribers in some cases (see above). While we do our best to provide these documents when available, there are occasions when the documents are unavailable and will not be provided. We make no guarantee that any particular case will include these free documents; they are provided only if they are available from the federal bankruptcy database.
Docket documents are purchased separate from any subscription and cost $.10 per page, with a maximum charge per document of $3.00 (in most cases1). Please note that we do not offer refunds on docket document purchases.
BusinessBankruptcies.com is an information provider only. We are not involved in any part of the bankruptcy process, the bankruptcy court, or any parties to a bankruptcy. We can not advise you regarding any aspects of bankuptcy or how to handle your involvement with any bankruptcy case.

The terms of use and acceptable use policy may be changed at any time. If we change these we will notify you by email and you will have the option to cancel your subscription and receive a refund on any unused portion of your subscription.
