| Sep 7, 2023 | DOCKET TEXT ORDER (no separate order issued:) This case comes before the court on a Motion Pursuant to B.L.R. 9006-1 Requesting Order Shortening Time filed by creditors Karen Chaplin and Jason Politte (Dkt. 13; the "Ex Parte Motion"). The Ex Parte Motion seeks a hearing on essentially no notice, at which Ms. Chaplin, Mr. Politte, and Debtor United Brands Products Design Development & Marketing, Inc. would like to request the court's approval of a concurrently filed Stipulation by and between Debtor, Ms. Chaplin, and Mr. Politte (Dkt. 12; the "Stipulation"). The Stipulation provides for the continuation of a jury trial that began on August 28, 2023 in a case involving Debtor, Ms. Chaplin, Mr. Politte, and other parties. The jury trial had nearly concluded when Debtor filed a voluntary petition for relief under Subchapter V of Chapter 11 of the United States Bankruptcy Code in this court on September 5, 2023. Upon Debtor's commencement of this bankruptcy case, the automatic stay arising under 11 U.S.C. § 362(a) prevented the jury trial from continuing. The court has carefully analyzed the Stipulation and the Ex Parte Motion. Based on that analysis, the court finds and concludes that the Stipulation and actions contemplated thereby will have minimal impact on the estate and other creditors, and that, if the court does not approve the Stipulation, the parties thereto will suffer extreme and unnecessary prejudice. Accordingly, the court orders as follows: (1) The Stipulation will be approved without a hearing; (2) Counsel for Mr. Politte and Ms. Chaplin shall promptly upload an order approving the Stipulation; and (3) The Ex Parte Motion is hereby denied.
