A hearing was held to consider the Motion and to consider whether to convert this case to a case under chapter 7 or dismiss the case, whichever is in the best interests of creditors and the estate, as required by 11 U.S.C. &sect 1112(b)(1). For the reasons stated on the record in open Court and it appearing that no previous conversions have occurred, the Court finds that the case should be converted to Chapter 7. IT IS THEREFORE ORDERED that: (1) this case be, and the same hereby is, converted to a case under Chapter 7 of the United States Bankruptcy Code; (2) the Office of the United States Trustee shall appoint a Trustee to serve in this case; and (3) a new meeting of creditors shall be scheduled, and that this case shall proceed as a Chapter 7.
