This matter comes before the Court pursuant to the Trustee's Motion for Order Authorizing and Approving Sale of Personal Property Free and Clear of all Liens, Claims, Encumbrances and Interests and Waiver of 14-Day Stay at Doc. 122 (the "Sale Motion"). A hearing on the Sale Motion was held on January 26, 2017. At the sale hearing, the Court approved a sale of the assets of the estate listed in the Sale Motion to Innova Global, Inc. ("Innova"). The Order approving the sale was entered January 27, 2017, at Docket No. 166. In addition to approving the sale to Innova, the Trustee also sought Court approval of "back up" bids submitted by PMFG, Inc. ("PMFG") and SISU Energy & Environmental, LLC ("SISU"). At the January 26, 2017, hearing the Court was asked to consider and approve the back up bids and determine that the bid of SISU be considered the first back up bid, and the bid of PMFG be considered the second back up bid. The Court declined to do so, given the likelihood that the sale to Innova would close on or before January 31, 2017. Accordingly, IT IS HEREBY ORDERED that, on or before 11 a.m. CST on Tuesday, January 31, 2017, Scott P. Kirtley, Trustee, shall file an advice with the Court in this case disclosing whether the sale of estate property to Innova has closed, as contemplated in this Court's sale order entered on January 27, 2017. IT IS FURTHER ORDERED that if the sale to Innova does not close, a hearing shall be held in on January 31, 2017, at 11:00 a.m., in Courtroom # 2, The Federal Building, First Floor, 224 South Boulder Avenue, Tulsa, Oklahoma, to consider the issue of the priority of the back up bids submitted by PMFG and SISU.
