Order: This chapter 7 case was filed under sec. 303 in February 2018. In a motion filed on April 1, 2022, to request approval of the trustee's compromise of a claim objection, the trustee suggested that after approval of that compromise and resolution of two other claim objections, she would be in a position to complete administration of the estate, writing, "The Trustee has also agreed toresolve her other two pending claims objections. As a result, following the completion of other administrative duties, such as completing tax returns, the Trustee will be in a position to conclude this chapter 7 proceeding and make final distributions to claimholders." ECF Nos. 278, at 6. By the end of April 2022, the court had approved the compromises to which the trustee had referred. ECF 306 & 307. Since then the docket has been mostly dormant, with the trustee filing statements of abandonment in December 2023 and January 2024. ECF Nos. 328 & 331. On October 7, 2024, the trustee filed an application for approval of compensation for previously employed accountants ECS Financial and Kimberly Siegel. The application seeks approval of more than $27 thousand of compensation and expense reimbursement in connection with "the following services: Prepared and filed 2017 through 2024 state and tax returns, prepared K-1's, and prepared year end federal and state bankruptcy estate income tax returns." ECF No. 332 at 4. The notice accompanying the application required that objections be filed by October 29, 2024. On October 28, 2024, Thomas J. Kammerait, an attorney representing Carol Catlin, filed correspondence (improperly because he did so using non-ECF means). ECF No. 335. The correspondence represents that James Catlin, Carol's deceased husband, sold all of his units in the debtor on December 1, 2017; it requests that "the K-1 issued to James Catlin be corrected [to] show[] no activity and no beginning or ending ownership" and that the debtor amend its "federal tax return . . . to remove James Catlin as being listed as a K-1 recipient." While the correspondence refers to Siegel's preparation of the disputed K-1, the correspondence does not object to the trustee's request to pay the estate's accountants. As a result, the court does not understand Kammerait's correspondence to be an objection to the trustee's pending application for approval of compensation nor does the court understand the correspondence as a request for relief from the estate or the trustee, since it neither makes such a request expressly nor identifies any authority for the court to grant such relief. Still, these recent events causes the court to wonder why this case has remained pending for so long and what else remains to be done before this case is fully administered? Accordingly, on or before November 13, 2024, the trustee must file correspondence that either (a) reports on the status of the case, including what has transpired since April 2022 and what else remains for the trustee to do before the estate is fully administered, including the dates by which the trustee expects to complete those tasks, or (b) requests that the court schedule a status hearing at which the trustee will provide an oral report on administration of the estate. s/ G.
