This case was commenced by the debtor filing a Chapter 11 petition on June 17, 2016. No plan was confirmed in the case and, after substantially all of the assets of this debtor were sold, the case was converted to Chapter 7 on January 20, 2017. The first meeting of creditors in the Chapter 7 case was held on March 23, 2017. There was a significant amount of avoidable preferential transfers made by the debtor; therefore, the trustee employed ASK, LLP as special counsel to analyze and litigate avoidance claims on behalf of the trustee. The trustee also employed Reed & Elmquist, P.C. ("R&E") as her general bankruptcy counsel. Between June 12 and June 15, 2018, the trustee filed 131 preference actions in which the trustee was seeking recovery of alleged preferential transfers totaling in excess of $17 million. All of the preference actions are now closed and the trustee received approximately $1,563,000 through the settlement of most of these preference actions. Default judgments were obtained in approximately twenty actions, and a number of the other preference actions were dismissed based on joint motions to dismiss filed by the parties. The trustee, through counsel, investigated a possible claim based upon alleged theft by a former CEO of the debtor. After investigation, it was determined that there is no claim to pursue. On September 2, 2020, the trustee filed a motion to sell the so-called "remnant assets" of the bankruptcy estate to Oak Point Partners, LLC for the sum of $10,000.00. This motion was approved by the Court and the trustee has received the $10,000.00 purchase price from Oak Point. On October 22, 2020, the trustee filed a motion to distribute to PNC Bank its cash collateral. This motion was granted and on or about November 24, 2020 the trustee distributed to PNC Bank its cash collateral totaling $212,911.00. The trustee's counsel has reviewed the secured, priority and chapter 11 administrative expense claims that have been filed and has resolved these claims by the claim being amended or withdrawn. Pursuant to the trustee's motion to distribute and order of the court entered in March 2021, the trustee made distributions to secured creditors and administrative claimants totaling approximately $43,000.00. In September 2021, the trustee received from the state of Texas unclaimed funds of BFN totaling approximately $84,000.00. These unclaimed funds and the proceeds of the remnant asset sale were distributed to PNC as its cash collateral after deducting the fees and expenses incurred by the trustee in obtaining these funds. The trustee is waiting on the filing of amended proofs of claim by BFN's largest creditors, PNC Bank and Crystal Financial.
