Report of Proceedings: A combined Pre-Trial Conference was held regarding Hoku Materials [13-40837] and Hoku Corporation [13-40838]. Initial comments by the Court. Comments by Mr. Elsaesser, Mr. Manwaring, Mr. Naess and Mr. Maynes, with questions by the Court. After discussion: The Court schedules the Final Hearing beginning May 31, 2016 at 9:00 a.m. through June 14, 2016. The Court's order will show the Movant has four days to present its case-in-chief. The Trustee will have four days for its case-in-chief, leaving 1 day for each side to present rebuttal evidence and testimony. The Court reserves 1 final day to accommodate any pending matter(s) if one exists. Additional deadlines will be addressed in the pre-hearing Order which will require any amendments or supplements to the pleadings be filed within 30 days of the date of entry of the Court's order. All discovery shall be completed by April 29, 2016. The Court recommended counsel contact the potential court reporter to discuss the possibility of daily transcripts. There was a brief discussion regarding stay orders entered in multiple adversary proceedings. The Court reminded counsel that stay orders were entered in cases addressed by the District Court. The Court anticipates entry of a pre-hearing order as soon as possible. The order will include a short deadline for parties to request modifications or changes.
